Since 1996, as an independent
neutral, Judge Conklin has worked with more than 300 different attorneys in
resolving disputes. In his private practice, about one-third (1/3) of the
matters Judge Conklin has mediated or arbitrated have involved construction,
real estate and business matter, one-third (1/3) personal injury and wrongful
death, and the remainder across a broad range of topics.
Judge Conklins primary focus has
been construction contract or defect issues, including case management
(approximately 1/3 of the caseload), personal injury and wrongful death actions,
including comparative fault analysis and worker’s compensation offsets
(approximately ¼ of the caseload), and business and contract matters, real
estate contract and development cases (approximately 1/5 of the caseload). He
has successfully mediated cases with disparate subject matters ranging from
private corporate dissolution to sexual harassment in an employment context.
Other dispute resolutions have involved such varied issues as governmental
activity, mobile home park law, estates, trusts and conservatorships.
Additionally, since he retired from the bench, he has
served as a trial judge in state court cases seeking petitions for a writ of
mandate invoking the California Environmental Quality Act (CEQA). He was
assigned in 2001 as judge in a lawsuit petitioning for class action status in
San Luis Obispo County.
He served as Special Master in the Buck Trust litigation
in Marin County,
California from October, 1991 thru December, 2001.
